This U.S. State Law Privacy Notice (the “Notice”) supplements the information contained in Playgap's Privacy Policy. The notice is for residents of California, Colorado, Connecticut, and Virginia and applies to residents of these states whose data we process as a “business” or a “controller” (“Applicable Residents”). It also describes how you exercise the rights under the California Consumer Privacy Act, the Colorado Privacy Act, the Connecticut Act Concerning Personal Data Privacy and Online Monitoring, the Utah Consumer Privacy Act, and the Virginia Consumer Data Protection Act (collectively the “U.S. State Privacy Laws”).
For purposes of this notice, “Personal Information” means information that identifies, or could reasonably be associated with, you, your device or household. Where applicable, Personal Information has the same meaning as those same terms or similar terms under the U.S. State Privacy Laws of the state in which you reside. We collect Personal Information when you visit www.playgap.io (the “Website”) and we collect Personal Information when you use our mobile application monetization and advertising services as, or on behalf of, a Playgap customer (the “Services”). Additionally, if you download and/or use a mobile application from a publisher that is using our Services, we collect certain Personal Information from your device via the Playgap software embedded in the mobile application (the “Playgap SDK”).

* We do not collect or seek to elicit end users' “sensitive personal information” as defined by State Privacy Laws. This means that we do not collect social security numbers, drivers' licenses, financial account or credit card numbers (except as provided by our business customers to us for payment processing purposes), precise geolocation, racial and ethnic characteristics, religious and philosophical beliefs, union membership, the contents of messages (mail, email, or text), mental or physical health condition or diagnosis, sex life or sexual orientation, genetic and biometric data, or personal data from a known child.
We do not “sell” information as most people would commonly understand that term or in the way that the applicable State Privacy Laws primarily define the term “sale.” The applicable State Privacy Laws define a “sale” as a disclosure of personal information to third parties for “monetary” and/or “other valuable consideration.” We will not disclose your personal information in direct exchange for money or some other form of payment.

If you are an Applicable Resident, you may be able to exercise the following rights in relation to the personal information that we may have collected about you, subject to certain limitations and requirements, including the verification of your identity and our right to retain information to comply with our legal obligations, among other circumstances.

Where permitted by applicable law, you may authorize another person (your “Authorized Agent”) to submit a request on your behalf through the methods described above. Your Authorized Agent should submit proof that you gave the agent signed permission to submit the request. We may still require you to directly verify your identity and directly confirm that you have provided the Authorized Agent permission to submit the request.
California's Shine the Light law permits California residents to request and receive, once per calendar year and free of charge, information about our sharing of your Personal Information (if any) with third parties for their own direct marketing use. If you are a California resident and would like to make such a request, please email contact@playgap.io. In your request, please include your name and attest to the fact that you are a California resident and provide a current California address. We may ask you for additional information to confirm your identity before responding to this request.
